Hi,My prev H1 was valid till Dec 2015.Recently I changed my job,the new company paid the H1B transfer cost and it is extended till Dec 2017. My wife's H4 is having the validity date till Dec 2015 (H1 from prev employer) .How do I extend my wife's H4 ? Do I need to contact Attorney for this ? My wife doesn't have any plans to visit India soon.2) Also would like to know if my previous employer cancels my old H1B status, will it impact my wife's H4 ? As this applied when I was working with the old company.Please advice.Thanks in advance,-A
Ideally your new employer should have concurrently filed H4 Extension with your H-1B transfer. However, the H4 extension can still be separately filed. If your new H-1B is just approved looking at your posting of this comment you need to apply for H4 Extension soon. Requires form G-28, form I-539, Check of $290, A cover letter, supporting documents your I-797 approval notice, Passport copy,recent salary slips, and your wifes passport copy, marriage certificate copy, previous approval, I-94. you can also file under premium processing if your wife plans to visit India.
